The petitioner/A2 had filed Crl.R.C.No.605 of 2024 seeking to set aside the dismissal order in Crl.M.P.No.2348 of 2024 passed by the Principal Special Court under EC & NDPS Act, Chennai dated 11.03.2024. Simultaneously, Ramkumar/A3 had also preferred a similar Criminal Revision Case in Crl.R.C.No.299 of 2024. Both the accused were aggrieved by dismissal of the bail petition, even though the period for filing the charge sheet has expired.

2.When Crl.R.C.No.605 of 2024 filed by the petitioner came up for consideration, the learned counsel had withdrawn the same and by an order dated 17.04.2024, a learned Single Judge of this Court had permitted withdrawal and had stated that liberty is granted to the petitioner to file regular bail application. The other Criminal Revision Case in Crl.R.C.No.299 of 2024 was argued by the learned counsel therein and a learned Single Judge by an order dated 23.02.2024 had granted bail.

smv 3.This petitioner also stands on the same footing. The words 'regular bail' would mean to approach the trial Court taking advantage of Section 167(2) of Cr.P.C. Without entering into any discussion on merits, this Criminal Original Petition stands dismissed and the petitioner may approach the trial Court seeking bail and may place reliance on the order dated 23.02.2024 in Crl.R.C.No.299 of 2024, Ramkumar Vs. State Rep. by the Inspector of Police.
