The instant application has been filed by the plaintiff seeking permission of the Court for effecting substituted service to the second defendant in the suit in any one of the local daily Newspapers published at Chennai in the State of Tamil Nadu.

2. It is seen from the records that notice taken to the second defendant through Court as well as by private mode returned with an endorsement as "no such person." It is asserted by the applicant/plaintiff that as per the last communication between the applicant/plaintiff and the second defendant, the last known address was mentioned in the plaint. The summons taken to the said postal address were returned with an endorsement as "no such person." In these circumstances, the applicant is seeking permission of the Court to effect substituted service.

3. Having satisfied with the reasons assigned in the affidavit filed in support of this application, the same is ordered. The applicant is directed to effect the service of summons by paper publication on the second defendant for next hearing on 07.07.2023. The paper publication shall be effected in "Dinamalar" Newspaper having vide circulation in the District of Chennai on or before 23.06.2023.
