ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 120-B, 408, 468, 471, 477-A of IPC in Crime No.4 of 2022, seeks anticipatory bail.

2. It is the case of the prosecution that there are totally 20 accused persons. The petitioner is arrayed as A-20. It is alleged that the accused persons conspired together and fabricated documents and have misappropriated to the tune of Rs.1,59,54,822/-, wherein the said accused persons sanctioned Agricultural loan in the name of dead persons in the Primary Agriculture Co-operative Society, Pelandurai. During the period of misappropriation, the petitioner herein worked as Circle supervisor between the year 2016 to 2019 and retired in the year 2019. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is arrayed as A-20 and he is only a field supervisor and he https://hcservices.ecourts.gov.in/hcservices/

is falsely implicated in this case as alleged by the case of prosecution. In fact, A-19 was arrested and subsequently released on bail by this Court on 18.05.2022. He further submitted that, the petitioner being the field supervisor, is no way connected with the said misappropriation. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Additional Public Prosecutor submits that the petitioner is the main person who in involved in the said offence and he is the field supervisor and misappropriated to the tune of Rupees 1 Crore 31 Lakhs and odd out of Rs.1,59,54,822/- from the Primary Agriculture Co-operative Society, Pelandurai and the said misappropriation happened between the year 2015 to 2020 and hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration that the petitioner misappropriated to the tune of Rupees 1 crore 31 lakhs and odd out of Rs.1,59,54,822/- and the custodial interrogation of the petitioner is essential. Hence, this Court, is not inclined to grant anticipatory bail to the petitioner.
