ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.02.2026 for the alleged offence under Sections 296(b), 103(1) of BNS, 2023 in Crime No.56 of 2026 on the file of the respondent police, seeks bail. 1/4

2. The case of the prosecution is that the deceased had relationship with the 1st petitioner's paternal uncle's wife. When this was questioned by the petitioners, there was a wordy quarrel and the petitioners allegedly attacked the deceased with stone and screw driver. Hence, the present case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioners have been falsely implicated in the present case and that they have not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been in judicial custody since 27.02.2026 and they are ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioners.

Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent Police strongly opposed the grant of bail to the petitioners, reiterated the prosecution case and submitted that the investigation is still in preliminary stage. Hence, he opposed the grant of bail to the petitioners.

5. Considering the totality circumstances of the case and also considering the nascent stage of the investigation, this Court is of the view that it is an inappropriate time to consider this bail application.

6. Accordingly, this Criminal Original Petition stands dismissed. 07.04.2026 mp To 1.The Inspector of Police, Thalaivasal Police Station, Salem District.
