This petition has been filed to call for the records culminating in C.C.No.9399 of 2010, pending on the file of the learned III Fast Track Court, Saidapet, Chennai and quash the same.

2. Heard the learned counsel for the petitioner.

3. When this Court was about to dismiss this petition on merits, learned counsel for the petitioner sought permission to withdraw this petition. Accordingly, this petition is dismissed as withdrawn. Consequently, connected M.P.No.1 of 2015 is closed.

4. At that juncture, learned counsel for the petitioner also sought to dispense with the personal appearance of the petitioner. The petitioner shall appear https://hcservices.ecourts.gov.in/hcservices/

before the Trial Court for receiving the papers under Section 207 Cr.P.C.; for answering charges; for questioning under Section 313 Cr.P.C., and on the date of judgment. For rest of the hearings, the presence of the petitioner can be dispensed with provided, her counsel gives an undertaking that he will cross examine the witnesses in the absence of the petitioner without adopting dilatory tactics. If the petitioner adopts any dilatory tactics, it is open to the trial Court to insist upon the presence of the petitioner.
