This case is taken up for settlement before the National Lok Adalat. Mr.D.Bhaskaran, learned counsel for the Appellant and Mr.K.V.Muthu Visakan, learned counsel for the Respondents 1 to 3 are present before this Court.

TERMS OF SETTLEMENT This Civil Miscellaneous Appeal had been filed by the Appellant/Insurance Company aggrieved by the award of the Tribunal granting a sum of Rs.15,90,600/- (Rupees Fifteen Lakhs Ninety Thousand and Six Hundred Only). The Appellant/Insurance Company had already deposited Rs.10,00,000/- (Rupees Ten Lakhs only). The Appellant/Insurance Company entered into an agreement with the Respondents 1 to 3/Claimants whereby, the Appellant/Insurance Company is agreed to deposit Rs.6,25,000/- (Rupees Six Lakhs and Twenty Five Thousand only), in full quit, in addition to the amount already deposited .

2. It was agreed that the Respondents 1 to 3/Claimants are entitled to receive the sum of Rs.6,25,000/- (Rupees Six Lakhs and Twenty Five Thousand only) in addition to the award already deposited by the Appellant/Insurance Company.

3. The Appellant/Insurance Company is directed to deposit the agreed amount within a period of 8 weeks from today.

4. On such deposit, the first Respondent/wife of the deceased is entitled to withdraw Rs.10,25,000/- (Rupees Ten Lakhs and Twenty Five Thousand only) with interest accrued, the second and third Respondents are entitled to Rs.3,00,000/- (Rupees Three Lakhs only) each. Consequently, connected miscellaneous petition, if any, is closed.
