ORDER

The writ petition has been filed for the following relief: "directing the 1st and 2nd respondents to take appropriate action on my representation dated 10.05.2025 to remove the name of the 4th respondent and enter my name as wife of the 3rd respondent in his Service Register with E.Code : 7198681/MEDL." 2.

The brief facts of the case are as follows:

It is the case of the petitioner that she got married to the third respondent on 04.04.2008 and thereafter, within a month of marriage, the third respondent deserted her and filed a suit in O.S.No.71 of 2008 to declare their marriage as null and void which was dismissed. Subsequently, the petitioner had filed a petition for restitution of conjugal rights in HMOP No.3457 of 2009, which was allowed on 08.02.2018. Meanwhile, the third and fourth respondents got married on 20.08.2010 and the third respondent revealed that the name of the fourth respondent was entered as his wife in the Service Register. Aggrieved by the same, the petitioner sent representations dated 10.05.2025 to the first and

second respondents to enter her name as Wife in the third petitioner's Service Register, for which, there is no response till date. Therefore, the petitioner is before this Court.

Heard the learned counsel on either side and perused the materials available on record.

A perusal of the records would show that the third respondent has denied the claim of the petitioner that she is his wife. It is also seen that the third respondent has filed a suit for declaration that the marriage which was forcibly solemnized between the petitioner and him as null and void in O.S.No.71 of 2008 on the file of the VI Additional Family Court, Chennai. The judgment dated 08.02.2018 passed in O.S.No.71 of 2008 has been challenged by the third respondent by way of filing an appeal in A.S.No.880 of 2019 on the file of this Court.

It is seen that the petitioner seeks to have her name included as Nominee in the Service Register of the third respondent, despite the fact that he is very much alive. The petitioner has to first establish that she is the legally wedded wife of the third respondent and only thereafter, she can seek a direction to the first and second respondents.

Therefore, this writ petition is premature and liable to be dismissed and is, accordingly dismissed. No costs.
