This petition has been filed to direct the 2nd respondent to investigate and register the complaint dated 03.09.2015 made by the petitioner.

The petitioner herein lodged a complaint with the 1st respondent about the illegal mining of sand in Palar river by the PWD officials and its contractor P.Karrupiah in S.No.835/P Pallar River at Vanivedu Village, Wallajah Taluk, Vellore district. The further allegation is that the entire PWD and Revenue officials have colluded with the illegal miners and the PWD contractors are also indulging in the illegal mining. The petitioner lodged a complaint with the respondent police on several occasions. One such complaint is dated 03.09.2015. But the second respondent police is not taking any steps on the said complaint.

When the matter is taken up for consideration, learned Additional Public Prosecutor submitted that the letter sent by the petitioner was already communicated to the Tahsildar, Wallajah, to take appropriate action on the persons who are illegally mining in the Pallar river and in this regard, the Collector has also sent a communication to the officials to enquiry into the matter and to take appropriate action. He further submitted that once an information is received from the concerned Tahsildar, the Police will take appropriate action.

Considering the facts and circumstances of the case and since the 2nd respondent police is yet to receive the reply from the Tahsildar concern, there is no need to give any specific direction to the respondent police. However, the respondent police is directed to expedite the process of enquiry and complete the same as early as possible.

The criminal original petition is disposed of accordingly.
