Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents to conclude the enquiry under S.10(3)(b) of the Passport Act, 1967 pending with them under file No.MA1070232380717 dated 11.05.2017 in pursuant to the Passport of the petitioner in Passport No.E0454155, within a time frame and to re-issue the Passport by renewing the same. Heard Mr.P.G.Thiyagu, learned counsel appearing for the petitioner and Mr.T.V.Krishnamachari, learned Senior Panel Counsel appearing for the respondent.

2. It is seen that an enquiry has been initiated under Section 10(3)(b) of the Passport Act, 1967, in respect of the petitioner's request for renewal of the Passport. The grievance of the petitioner is that the said enquiry has not been completed so far. Even though the petitioner has made averments in the affidavit filed in support of the writ petition justifying his claim for renewal of the Passport, this Court is not inclined to express any view on those contention, as it is for the respondents to consider and decide the same on its merits and in accordance with law.

Therefore, without expressing any view on the merits of the matter, this writ https://hcservices.ecourts.gov.in/hcservices/

petition is disposed of, only with a direction to the respondents to conclude the enquiry initiated under Section 10 (3)(b) of the Passport Act, 1967 and pass orders on the same on its merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after providing an opportunity of hearing to the petitioner. No costs.
