Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, seeking direction as against the DRT Coimbatore to take up and dispose of SA.No.766 of 2023. For the Petitioner : Ms.Ananda Gomathy

ORDER

(Made by the Hon'ble Chief Justice) Heard Ms.Ananda Gomathy, learned counsel for the petitioner.

2. The present petition is filed seeking directions to decide the securitisation application filed by the borrower/guarantor.

3. The learned counsel appearing for the petitioner submits that in the said proceedings, interim orders are passed in favour of the borrower/guarantor by the Presiding Officer, Debts Recovery Tribunal and now, the matter is not being heard. The matter is required to be decided within three months.

4. We are not aware of the number of matters pending before the concerned Debts Recovery Tribunal. However, as stay is granted by the Debts Recovery Tribunal, the petitioner may make a request to the concerned Debts Recovery Tribunal to take up the matter expeditiously, which request would be considered by the Debts Recovery Tribunal on its own merits.

5. The writ petition, accordingly, stands disposed of. There shall be no order as to costs.
