ORDER

The impugned letters of the second respondent namely, Letter No.AS5 / 3613 / 2013 dated 29.02.2024 and the consequential Letter No. AL 5 / 3613 / 2013 dated 13.03.2024, are put under challenge in the present Writ Petition. Further, the petitioner has sought for a direction to the respondents to continue the maintenance and make the petitioner as watchdog till the occupancy of all flats.

2. Heard the learned counsel appearing on either side.

The learned counsel for the petitioner submitted that the petitioner is a TNHB 1500 MSB Flat Owners Welfare Association, Sholinganallur, which had made several representations to the respondents to hand over the maintenance of 1500 MSB Flats and common amenities to their association, however there was no response. He further submitted that the second respondent without considering their representations, had passed the impugned letters dated 29.02.2024 & 13.03.2024, intimating them that the maintenance of 1500 MSB

was handed over to some other Association, namely TNHB Unity Flat Owner Association, Sholinganallur and aggrieved by the impugned letters of the second respondent, the present Petition has been filed.

Per contra, the learned counsel for the respondents submitted that during the pendency of the Writ Petition, the respondents/Housing Board had handed over the subject properties, viz., the maintenance of 1500 MSB Flats and common amenities in favour of the President of the Tamil Nadu Housing Board Unity Flat Owners Association, Sholinganallur and therefore, nothing survives for further adjudication in the matter and thus, prayed for appropriate orders.

In view of the submissions of the learned counsel for the respondents and taking note of the fact that the maintenance of the entire common amenities and 1500 MSB Flats of the subject issue were handed over to the President of the Tamil Nadu Housing Board Unity Flat Owners Association, Sholinganallur on 27.04.2024 itself and the same came into force with effect from 01.05.2024, no further order is required in this matter. However, the petitioner is at liberty to work out his remedy against the President of the TNHB Unity Flat Owners Association, Sholinganallur in the manner known to law.

6. With the above observations, the Writ Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. There shall be no order as to costs.
