O R D E R

This Criminal Original Petition has been filed to direct the respondent to register the case on the basis of the complaint dated 21.09.2015 given by the petitioner and investigate the matter in accordance with law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

3. The learned Additional Public Prosecutor submitted that the respondent police conducted enquiry on the complaint dated 21.09.2015 and closed the same on 12.10.2015 as civil in nature.

4. This Court perused the complaint dated 21.09.2015 and found that the opposite party was working under the petitioner https://hcservices.ecourts.gov.in/hcservices/

and he has been defalcating amounts from the company over a period of time to the tune of Rs.3,30,000/-. The opposite party has also given a statement dated 23.04.2015, in which, he has admitted that he has misappropriated the money from the company.

5. Under such circumstances, this Court sets aside the closure report dated 12.10.2015 and directs the respondent police to conduct enquiry and take action in accordance with law.

In view of the above, the criminal original petition is closed.
