This petition has been filed to direct the respondent to file the final report in Crime No.443 of 2011 dated 02.09.2011 within the stipulated time.
2. The case of the petitioner is that on 01.09.2011 while her husband was returning to the house after work in a bicycle, at 12.15 hours, he was hit by a motor vehicle, Hero Honda Spendor, bearing Registration No.TN 73 Z 9822, due to which, he sustained severe injuries and he was taken to hospital for treatment. Subsequently, on 04.09.2011, he died due to the injuries sustained by him. A complaint was lodged immediately on the date of accident i.e., on 02.09.2011 and the same was taken on file in Crime No.443 of 2011 for the offence under sections 279, 337 and 304(A) IPC, but till date, the investigation has https://hcservices.ecourts.gov.in/hcservices/
not been completed and charge sheet has not been filed.
3. Learned Additional Public Prosecutor submitted that the vehicle was returned to the accused and it has to be secured and sent for Motor Vehicle inspection and that would take considerable time. Hence, he prayed for sufficient time to file the final report.
4. Considering the submission made by the learned Additional public Prosecutor, this Court directs the respondent police, to complete the investigation and file a final report in Crime No.443 of 2011 as early as possible, preferably within a period of four months from the date of receipt of a copy of this order. Accordingly, the criminal original petition is disposed of.
