Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issue of a Writ of Mandamus to direct the respondent to dispose the representation made on 14.10.2019 by the petitioner.

O R D E R

The prayer sought for in this writ petition is to direct to dispose the representation made on 14.10.2019 by the petitioner.

2. The petitioner is the daughter of one Late Annamalai, who was a freedom fighter. In this regard, the mother of the petitioner one Parvathi ie., the wife of the late freedom fighter is getting Freedom Fighters Family Pension. Detailing this, the respondent Tahsildar has given a certificate in Na.Ka.1283/2008/A4 dated 28.03.2018 certifying that, the petitioner is the daughter of the Late Annamalai freedom fighter whose wife ie., the mother of the petitioner is getting Freedom Fighter Family Pension. Like that in the same Na.Ka.No., two more certificates were given by the respondent Tahsildar stating that, the daughter as well as the son of the petitioner are the maternal grand children of the Late Annamalai, freedom fighter.

3. These certificates were issued on the request of the petitioner for the purpose of getting the benefits extended by the State Government to the legal heirs of the freedom fighters.

4. However, in the said certificates, the name of the petitioner has been mentioned as 'Santhakumari' instead of 'Santhikumari'. Like that, in the address it has been

mentioned as 'Nethaji Nagar' instead of 'Jothi Nagar'.

In order to rectify these mistakes that had occurred in the certificates mentioned above, the petitioner has given a representation on 14.10.2019 to the respondent and the said representation since has not been considered and the rectification sought for by the petitioner has not been made by the respondent so far, aggrieved by the same, the petitioner filed the present writ petition with the aforesaid prayer.

Heard Mr.V.Nandagoopalan, learned counsel for the petitioner, who would submit that, he would be satisfied if a direction to that effect is given to the respondent to consider the representation of the petitioner to carry out the corrections as required therein within a time frame that may be stipulated by this Court.

Heard Ms.Radhika, learned Government Advocate who would submit that, the said representation of the petitioner dated 14.10.2019 would be considered by the respondent Tahsildar on merits and in accordance with law and if really the mistakes now pointed out by the petitioner has occurred due to inadvertence in the above referred certificates issued by the respondent to the petitioner, the same would be rectified after verifying the same and the needful as sought for would be undertaken by the Tahsildar within a time frame that may be stipulated by this Court.

8. I have considered the submissions made by the learned counsel for the petitioner as well as the learned Government Advocate for the respondent and also perused the materials placed on record.

9. In view of the aforesaid, as the prayer sought for is innocuous in nature, this Court is inclined to dispose of this writ petition with the following order.

The respondent is hereby directed to consider the representation of the petitioner dated 14.10.2019 and accordingly make necessary amendment to correct the certificates dated 25.03.2018 issued in this regard by the respondent to the petitioner, after verifying the same and the aforesaid action shall be undertaken by the respondent within a period of four weeks from the date of receipt of a copy of this order.

11. With the above direction, this writ petition is disposed of. No costs.
