The petitioner, who was arrested and remanded to judicial custody on 10.03.2024 for the alleged offences punishable under Sections 294(b), 307, 323, 341, 392, 506 (ii) of IPC and 3(1) of Tamil Nadu Public Property (Prevention of Damage and Loss) Act, in Crime No.71 of 2024 on the file of the respondent Police, seeks bail.
2. Learned counsel appearing for the petitioner submitted that the petitioner (A2), aged about 25 years is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is no way connected with the alleged offence and he is in custody from 10.03.2024. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that the petitioner along with other accused, who are the friends of the de facto complainant's brother, in an inebriated condition, quarreled with the de facto complainant, during which, the accused had abused him in a filthy https://www.mhc.tn.gov.in/judis

language and attacked the de facto complainant and others, causing grievous injuries and also damaged the Auto belongs to one Ethiraj, which was parked nearby. He further submitted that the petitioner, who is arrayed as A2, is having nine previous cases and further, the investigation is still pending.
4. Heard the learned counsel for the petitioners and the learned Government Advocate (Criminal Side) appearing for the respondent and perused the materials available on record.
5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and also considering the previous antecedents of the petitioner, this Court is not inclined to grant bail to the petitioners.
