O R D E R

Though this Contempt Petition is filed for not refunding the amount deposited as Earnest Money Deposit as directed by this Court in W.P.No.34465 of 2014 dated 10.11.2022, learned counsel for the respondents brought to the notice of this Court the judgment passed by the Division Bench of this Court in W.A.No.2969 of 2023 dated 31.10.2023 wherein the Division Bench has modified the order passed by this Court and directed the respondents to refund a sum of Rs.22.88 Lakhs to the petitioner within a period of three weeks from 31.10.2023. The question of paying interest will arise only if the said principal amount is not paid in time as directed by this Court. The judgment has been passed by the Division Bench of this Court only on 31.10.2023 and the time to refund the amount is still available. In such view of the matter, at this stage, no contempt is made out and the contempt petition is accordingly closed.
