O R D E R

The petitioner has filed this writ petition praying for to issue an order or direction or Writ more specifically Writ of Certiorarified Mandamus calling for the records relating to the order of the respondent dated 04.08.2004 issued in a G.O.Ms. No.424 Finance (Pay Cell) Department and quash the same and further direct the respondent to pay arrears of pay and 60% of the terminal benefits withheld by the respondent for those who had retired from service between 01.01.1996 to 31.03.1998 forthwith with interest.

2. Today, when the matter was taken up for hearing, the learned counsel for the petitioner submitted that the prayer sought for in the writ petition has become infructuous since the arrears of pension already paid and nothing survive in this writ petition. He has also made an endorsement to that effect.

3.In view of the endorsement made by the learned counsel for the petitioner, the writ petition is dismissed as having become infructuous. No costs. Consequently connected miscellaneous petition is closed.
