ORDER
The writ petition has been filed directing the respondents 1 and 2 to constitute an appropriate Special Investigation Team (SIT) to investigate the crimes in FIR.No.102 of 2022 on the file of the 4th respondent, Inspector of Police.
2. The grievance of the writ petitioner is only at the instance of this Court, he is made as witness in the criminal case and there is huge conspiracy in dealing with the property by Diocese and there is misappropriation, therefore, seeks a direction.
3. The learned Additional Public Prosecutor submitted that final report is filed and the petitioner is listed as witness as LW10.
4. Heard both sides and perused the materials placed on record. Admittedly, final report is already filed and the petitioner is also made as witness as LW10. Such view of the matter, let the petitioner give his substantive evidence in the criminal case. If any incriminatory materials come on record against anybody, it is the discretion of the criminal court to apply its mind and proceed against others on evidence.
