[R.C.NO.41(A)2000] Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed by this Hon'ble Court that the appellant shall appear before the said trial court on every Monday on every week at 10.30 a.m pending appeal vide in Crl.M.P.No.4928 of 2017 in Crl.A.No.205 of 2017 dated 10.05.2017.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.A.T.ANBU KUMAR, Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner by this court in Crl.M.P.No.4928 of 2017 in Crl.A.No.205 of 2017 dated 10.05.2017, directing the petitioner shall report before the concerned Court, once in a week i.e., on every Monday at 10.30 a.m., until further orders.

2. The learned counsel for the petitioner would submit that since the date of release on bail, the petitioner had been regularly complying with the condition for the past more than one year. The learned counsel would submit that there is a typographical and clerical error in the petition wherein it has been wrongly stated in para 5 "that the petitioner after his slight recovery had appeared before the Trial Court to comply with the condition on 18.06.2018, but the Court below decline to permit him to sign as per the conditions since he was absent on 07.05.2018 and directed him to get relief from this Court" . He would request that para 5 of the petition may be deleted and would submit that infact the petitioner had been regularly complying with the condition and would pray for relaxation of bail condition. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Additional Public prosecutor would submit that the petitioner has been regularly complying with the condition.

4. Taking into consideration of the submissions made by the counsels on either side, the condition imposed by this court in Crl.M.P.No.4928 of 2017 in Crl.A.No.205 of 2017 dated 10.05.2017 is modified and the petitioner shall appear before the trial Court on the first working day of every English Calender month at 10.30 a.m., until further orders.
