Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to consider the petitioner appeal dated 13.11.2014 preferred against the order of the District Manager in Say Mu Ka No.A-4-9130-2012 dated 28.11.2012 thereby directing the respondent to dispose of the appeal within a time stipulated.

By consent, the Writ Petition is taken up for final disposal. 2.

The petitioner, who was employed as Salesman under the services of the Tamil Nadu State Marketing Corporation Limited, was working in Shop No.9130, Poovalmedu, Thiruvellore District and according to him, a surprise inspection had conducted by the District Manager on 19.04.2012 based on a false complaint alleging certain irregularities and that he was on leave on that day. he was dismissed from service under order dated 28.11.2014. The petitioner, challenging the legality of the said order, filed an appeal before the respondent on 13.11.2014. Since, it has not been given disposal, he came forward to file this Writ Petition. 3.

Heard the learned Counsel appearing for the petitioner and Mr.S.Muthuraj, learned Counsel who accepts notice on behalf of the respondent.

This Court taking into consideration the limited prayer sought for by the petitioner and without going into the merits of the same, directs the respondent to consider and dispose of the appeal petition/memorandum dated 13.11.2014 filed by the petitioner on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this Order and communicate the decision taken to the petitioner.
