Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the second respondent to consider the claim of the petitioner for promotion as Manager based on Clause (1), Clause (4) of Subsidiary Regulations of Schedule 'A' of Regulation of The Health Staff Cooperative Credit Society Ltd., C-428, Karaikal and promote the petitioner as Manager and pass orders in the light of the representation made by the petitioner dated 3.7.2015, and grant her all consequential service and monetary benefits. ORDER

By consent, the writ petition itself is taken up for final disposal.

2.The petitioner would state that she has passed Higher Secondary Examination and was appointed as a Clerk on consolidated basis on 1.9.1995, and subsequently, absorbed as a Junior Clerk. The petitioner would claim that she was falsely implicated and was visited with the Disciplinary Proceedings and initially, she was placed under suspension and subsequently, reinstated in service. 3.The grievance expressed by the petitioner, is that the respondents in order to prevent the petitioner from getting promotion as Manager, thought fit to introduce a System, wherein, each Society is construed to be a Unit of appointment and promotion, and the said Clause has been introduced only to prevent the petitioner from getting her promotion as Manager, and she, in this regard, has submitted a representation dated 27.1.2015, followed by a reminder dated 3.7.2015, and since no orders have been passed, came forward to file this writ petition.

4.Heard the submissions of Mr.K.Venkataramani, learned Senior Counsel, appearing for the petitioner, and Mr.R.Sridhar, learned Government Advocate (Pondy), who accepted notice on behalf of the respondents.

5.Though the petitioner prayed for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of either the representation, or the writ petition, directs the second respondent to consider and dispose of the petitioner's representation dated 27.1.2015, and the reminder dated 3.7.2015, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
