O R D E R
This petition is filed to withdraw H.M.O.P.No.16 of 2016 pending on the file of the Family Court, Nilgiris at Ootacamund and transfer the same to the file of the Subordinate Court, Avinashi.
2.The learned counsel for the petitioner submitted that the petitioner filed H.M.O.P.No.155 of 2016 on the file of the Subordinate Court, Avinashi, for restitution of conjugal rights. Though the respondent/wife is residing at Karuvalur Post, Tirupur District, within the jurisdiction of the Subordinate Court, Avinashi, she has filed H.M.O.P.No.16 of 2016 for divorce against the petitioner/husband, on the file of the Family Court, Nilgiris at Ootacamund, only to harass the petitioner.
3.The learned counsel for the respondent/wife submitted that the petitioner has participated in the trial before the Family Court, Nilgiris at Ootacamund and now after completion of trial, H.M.O.P.No.16 of 2016 is posted for judgment on 25.04.2018. The https://hcservices.ecourts.gov.in/hcservices/
learned counsel for the petitioner has not denied the said contention.
4.In view of the above submissions, the Transfer Civil Miscellaneous Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
