Post this matter before the Additional Master - III on 08.12.2023 for recording evidence.

2.It is made clear that the evidence on the side of the plaintiff shall be completed on or before 19.12.2023. Failure to adduce evidence before the Additional Master - III, the matter may be listed before this Court for dismissal. This order has been passed taking note of the fact that despite several adjourments were granted to adduce evidence, the plaintiff has not chosen to come before the Court to withstand the cross examination. However, he is insisting only on the technicalities to argue the objections filed in interlocutory applications. This Court is of the view that the objections filed with regard to the Receiver report can be taken note of at the time of deciding the main Suit itself. No further arguments is required in this application.
