PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent to register the case based on the complaint of the petitioner dated 21.01.2021 and to investigate the matter.

ORDER

This petition has been filed to direct the respondent to register the case based on the complaint of the petitioner dated 21.01.2021 and to investigate the matter.

2. The learned Public Prosecutor submitted that the petitioner is the mother of one Mohamed Masthan, aged 19 years, and he is a special child suffering form Autism. The said Mohamed Masthan was admitted in "Maithree Group Home" at Vembakkam Village, Kanchipuram. During his stay at the said Home, the caretaker one Nanda Kumar is said to have assaulted her son. Hence, she lodged a complaint, which was taken by the respondent police and CSR.No.23 of 2021 was assigned on 21.01.2021. Further, the petitioner was directed to produce medical records or other relevant records to show as a proof for the allegation made in the complaint. However, the petitioner failed to appear, and filed this petition.

3. In view of the submissions made by the learned Public Prosecutor, the petitioner is directed to appear before https://hcservices.ecourts.gov.in/hcservices/

the respondent police along with her son and produce the documents, which are available with her, so that proper enquiry can be initiated. The petitioner being a lady, whenever she appears before the respondent Police, she has to be dealt peacefully. The grievance of the petitioner mother of Autism child to be considered sympathetically. All endeavours to be made to redress the grievance of the petitioner.

4. With the above observation and directions, this Criminal Original Petition is disposed of .
