Balakrishnan S/o.Kuppusamy ..Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus forbearing the respondents 1 to 3 from granting any approval sanction subsidy or benefit in favour of the fourth respondent for construction of any superstructure in respect of the property comprised in survey No.68/16 an extent of 12.3 cents situated at Kottamettu Street, Periyanarkunam Village, Bhuvanagiri Taluk, Cuddalore District, unless the property is duly partitioned by metes and bounds considering the petitioner's representation dated 14.03.2026 and appropriate order to that effect within stipulated time.

ORDER

The relief sought for in this writ petition is a private dispute between the petitioner and the fourth respondent. This Court expressed its view to the learned counsel for the petitioner that only a civil suit is maintainable.

2. Learned counsel for the petitioner has accepted the view of this Court and he seeks liberty for the petitioner to approach the civil Court against the fourth respondent.

Accordingly, this writ petition is disposed of as not maintainable and liberty is granted to the petitioner to file a civil suit as against the fourth respondent and other parties in respect of the grievance raised in this writ petition. No costs.
