Second Appeal filed under Section 100 of C.P.C., against the judgment and decree dated 19.10.2001 made in A.S.No.52 of 2000 on the file of Sub Court, Tiruvarur, confirming the judgment and Decree dated 25.04.2000 in O.S.No.242 of 1998 on the file of the District Munsif Court, Tiruvarur.

This second appeal was listed on 08.12.2017 and on that date, there was no representation for the appellants and the appellants called absent. It is further found that, in as much as the first respondent had already been reported dead and despite the direction given to the appellants to implead her legal representatives on record, for continuation of the second appeal, as per law, no steps have been taken by the appellants to bring the L.R's of the deceased respondent on record. This shows that the appellants have not been diligent in the prosecution of second appeal and accordingly, the matter was listed today (i.e) on 11.12.2017 under the caption "for dismissal".
2.Today also, no steps have been taken in respect of the deceased respondent.
