C.S. No.293 of 2018 ABDUL QUDDHOSE, J Learned counsel for the plaintiff has filed a memo dated 23.10.2021 before this Court stating that the dispute between the parties have been settled out of court.

2. Learned counsel for the defendants has also present and he also agrees with the statement made in the memo filed by the plaintiff.

3. The memo dated 23.10.2021 reads as follows: "Memo filed by the Plaintiff The plaintiff states that the dispute between the plaintiff company and the 1st defendant has been settled out of court with legal assistances of respective counsels and they settled all the disputes in respondent of other cases pending against each other between them by entering into memorandum of understanding dated 19th July 2021.

Pursuant to said memorandum the 1st defendant has handed over the documents, tax receipts, vouchers and other relevant documents of the plaintiff company and settled the disputes once for all and plaintiff company has decided to withdraw the above suit as settle out of court.

Therefore it is prayed that the plaintiff company may be 1/3

permitted to withdraw the suit as settled out of court and consequentially to refund of the court fee in the name of plaintiff and render justice."

4. In terms of memo, the suit is dismissed as settled out of Court.

5. Registry is directed to refund the entire court fee after usual deductions to the plaintiff.
