PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Certiorari, to call for all the records relating to the impugned order Na.Ka.No.1164/2023/A7 dated 25/03/2023 issued by the 1st respondent and quash the same.

ORDER

This writ petition has been filed challenging the impugned notice issued by the 1st respondent dated 25.03.2023, calling upon the petitioner to participate in the enquiry proceedings initiated based upon the application submitted by the 2nd respondent, seeking for cancellation of patta issued in favour of the petitioner for the property more fully described in the affidavit filed in support of this writ petition.

2.The petitioner has approached this Court even before a final decision has been taken by the 1st respondent, on the 2nd respondent's application, seeking for cancellation of petitioner's patta. The petitioner contends that she is the absolute owner of the property more fully described in the affidavit filed in support of this writ petition. She has also filed the documents in support of her

contention. However, the same has been disputed by the 2nd respondent, as seen from the 2nd respondent's representation to the 1st respondent seeking for cancellation of petitioner's patta.

3.Necessarily the petitioner will have to participate in the proceedings of the 1st respondent initiated based on the 2nd respondent's representation, seeking for cancellation of petitioner's patta. All the objections that have been raised by the petitioner before this Court through this writ petition can very well be raised by the petitioner before the 1st respondent. Instead of raising the said objections before the 1st respondent, the petitioner has approached this Court prematurely by filing this writ petition without waiting for the final decision of the 1st respondent on the 2nd respondent's representation. 4.

Since this writ petition has been filed prematurely without waiting for the 1st respondent's final decision, the petitioner is directed to participate in the proceedings initiated by the 1st respondent pursuant to the 2nd respondent's representation, seeking for cancellation of patta, by raising all the objections before the 1st respondent including the written objection that necessarily the 1st respondent will have to consider on merits and in accordance with law, after giving due consideration to the supporting documents filed by the petitioner to substantiate the petitioner's contention that the 2nd respondent is not entitled for cancellation of petitioner's patta.

5.This Court is not expressing any opinion on the merits of the contentions made by the respective parties.

6.In the result, this writ petition is disposed of by directing the petitioner to submit her written objection with regard to the 2nd respondent's representation seeking for cancellation of petitioner's patta for the property more fully described in the affidavit filed in support of this writ petition, within a period of two (2) weeks from the date of receipt of a copy of this Order. On receipt of the said objection from the petitioner within the stipulated time, the 1st respondent shall give a due consideration to the said objection; supporting documents as well as the contentions of the 2nd respondent and pass final orders on merits and in accordance with law, within a period of twelve (12) weeks thereafter. The 1st respondent shall also furnish the petitioner with the copy of the representation given by the 2nd respondent seeking for cancellation of petitioner's patta. No costs.
