ORDER
This Writ Petition is filed to direct the third respondent to refer the petitioner's application seeking for enhancement of compensation under the award, dated 31.12.2020 to the Reference Court as per the provisions of Section 8 of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, based on the petitioner's representation, dated 25.02.2023, within the time frame to be fixed by this Court.
2. According to the petitioner, he is entitled for enhanced compensation. Not satisfied with the award, dated 31.12.2020, the petitioner had submitted an application on 17.02.2021 to the respondents requesting the respondents to refer the matter to the Reference Court as per the provisions of Section 8 of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 to enable the petitioner to get enhanced compensation. Since the petitioner's representation, dated 25.02.2023 has not been considered till date, the petitioner has filed this Writ Petition. 2/5
3. Mr.M.R.Gokul Krishnan, learned Additional Government Pleader accepts notice on behalf of the respondents.
4. No prejudice will be caused to the respondents if the petitioner's representation, dated 25.02.2023, as referred to supra, is considered on merits and in accordance with law by the third respondent within the time frame to be fixed by this Court. This Court is not expressing any opinion on merits of the petitioner's representation.
5. Accordingly, this Writ Petition is disposed of by directing the third respondent to consider the petitioner's representation, dated 25.02.2023 seeking for reference to the Reference Court as per the provisions of Section 8 of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 to enable the petitioner to get enhanced compensation in respect of the award, dated 31.12.2020 within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
