The Original Side Appeal filed under Order 36 Rule 9 of O.S.Rules read with Clause 15 of amended Letters Patent 1805, against the Judgment and Decree dated 30.10.2017 in Tr.C.S.No.769 of 2008 and direct the respondent to handover the remaining premises of the suit property to the petitioner respondent retaining 2 rooms in the first floor and one room in the ground floor in the occupation of the respondent by modification on of the prayer in para 24(C) of the written statement of the petitioner.

DECREE:This Original Side Appeal coming on for hearing on Friday the Eighteenth day of June Two Thousand and Twenty One upon persuing the grounds of appeal, and made in the exercise of the Jurisdiction of the High Court in Tr.C.S.No.769 of 2008 and all other papers material to this case, and upon hearing the arguments of Mr.Babu for Mr.K.S.Govinda Prasad Advocate for the Appeallant, and of Ms.S.P.Arthi Advocate for the respondent, and having stood over for consideration doth till this day, doth Order and Decree as follows:

i)That the Judgment and Decree dated 30.10.2017 made in Tr.C.S.No.769/2008 on the file the High Court, Madras be and hereby is confirmed and the Original Side Appeal is dismissed;
