The relief sought for in this application is to pass an order prohibiting the Garnishee / fourth respondent from releasing any amount from the Account No.020205006223 in the name of A & G Associates and Account No.020305500666 in the name of Gurudev Hospital which is operated by the respondents 1 to 3 up to sum of Rs.29,38,676/- and further direct Garnishee / fourth respondent to deposit up to the said amount before this Court to the credit of the above application pending initiation and disposal of arbitration proceedings between the applicant and the respondents and till enforcement of the award that may be ultimately passed in the arbitration proceedings.

2. By an order dated 30.04.2019, this Court restrained the Garnishee / fourth respondent from releasing any amount to the extent of Rs.29,38,676/- from the Account No.020205006223 in the name of A & G Associates and Account No.020305500666 in the name of Gurudev Hospital, till 06.06.2019.

3. At this stage, it appears that arbitration proceedings had already been initiated and pending. In view of the same, the interim order already granted by this Court on 30.04.2019 is made absolute till the completion of arbitration proceedings. http://www.judis.nic.in

mbi The applicant is at liberty to seek any other remedy under Section 17 of the Arbitration and Conciliation Act, 1996 before the arbitrator.
