Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing the respondents to alter the petitioner's date of birth as 19.06.1959 instead of 07.08.1958 in all his school and college education certificates and his service register maintained by the respondents department and enable the petitioner to continue his job till completion of his original superannuation age as per his date of birth 19.06.1959, based upon his representation dated 02.05.2016. Mr.K. Karthikeyan, learned Government Advocate takes notice for the respondents. By consent, the main writ petition is taken up for final disposal.

The petitioner, who started his career as an Assistant Professor in Botany in Namakkal Government Arts College, is presently working as Regional Joint Director, Collegiate Educational Department, Thirunelveli Region. According to the petitioner, recently, he came to know that his original date of birth is 19.06.1959 through certain records but, in the school and college records and in his service register, it has been wrongly https://hcservices.ecourts.gov.in/hcservices/

entered as 07.08.1958. Hence, he approached the Melur Muncipality, Madurai District and applied for birth certificate and in the said birth certificate issued, his date of birth was found mentioned as 19.06.1959. Thereafter, in order to alter his date of birth as 19.06.1959 instead of 07.08.1958 in all his school and college education certificates and in the service register, the petitioner submitted a representation to the 1st respondent on 02.05.2016. However, no orders have been passed on the said representation. Hence, the petitioner has come forward with the present writ petition.

Considering the pendency of the representation of the petitioner dated 02.05.2016, without going into the merits of the case, this Court directs the 1st respondent to consider and pass appropriate orders on the said representation of the petitioner, after taking into account the birth certificate issued by the Commissioner, Melur Municipality, Madurai District, within a period of three weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs. Sd/- Vacation Officer Corrected as per order of this court dated 07.06.2016 made in WP No.18473/16.
