Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorari, calling for the entire records pertaining to the order of the respondent in No.TN/CBE/ Adm.I/A7/Pension/5230/20156 dated 2.5.2016 and quash the same. ORDER

The relief sought for in this writ petition is to call for the records in relation to the order passed by the respondent in proceedings dated

2.5.2016.

2. The writ petitioner was employed as Section Supervisor in the Office of the Regional Provident Fund Commissioner and retired from service on 30.4.2015.

3. The grievance of the writ petitioner is that the pension benefits due to the writ petitioner are withheld by the respondentemployer. The writ petitioner was an employee of the Office of the Regional Provident Fund Commissioner and the same is a Body Corporate and further the Provident Fund Organisation is notified under the provisions of the Administrative Tribunals Act, by the Government of India.

4. This being the factum of the case, the aggrieved employees of the Provident Fund Commission has to approach the Central Administrative Tribunal for the purpose of redressing their grievances under the Administrative Tribunals Act. Thus, this Court has no jurisdiction to entertain the writ petition. In respect of the grievances of the writ petitioner, the writ petitioner is at liberty to approach the Central Administrative Tribunal to redress his grievances.

5. Accordingly, the writ petition stands closed. However, there shall be no order as to costs. Consequently, connected miscellaneous petitions are also closed.
