ORDER

This miscellaneous petition has been listed today under the caption "For Being Mentioned" at the instance of the learned counsel for the petitioner for correction.

2. Heard both sides.

3. The Government Advocate (Criminal Side) for the respondent police would submit that the petitioner had been regularly complying with the conditions imposed on him by reporting before the respondent police daily twice at 10.30 a.m. and 05.30 p.m. Subsequently, the petitioner had filed a miscellaneous petition in Crl.M.P.No.4779 of 2022 seeking to relax the conditions which was partly ordered and thereby the conditions imposed earlier were modified with a direction to the petitioner to appear before the Magistrate concerned on the first working day of every month at 10.30 a.m. until further orders. Thereafter, again the petitioner came up with another miscellaneous petition in Crl.M.P.No.7043 of 2023 seeking complete relaxation of the conditions and this court, by order dated 26.05.2023, allowed the aforesaid miscellaneous petition and relaxed the condition, however, with a direction to V. the petitioner to appear before the Magistrate concerned as and when required. But, in the order, it was stated that 'the petitioner shall report before the Judicial Magistrate-II, Jayankondam, once in a fortnight at 10.30 a.m. until further orders'.

In view of the above submissions, the order of this court dated 26.05.2023 made in Crl.M.P.No.7043 of 2023 is modified to the effect that the petitioner shall appear before the Judicial Magistrate-II, Jayankondam, as and when required by the court for the effective progress in the committal proceedings. Accordingly, the Registry is directed to make necessary corrections in the order dated 26.05.2023 by substituting the words "petitioner shall report before the learned judicial Magistrate-II, Jayankondam, once in two weeks at 10.30 a.m., until further orders" with the words "petitioner shall appear before the learned Judicial Magistrate-II, Jayankondam, as and when required by the court for the effective progress in the committal proceedings".
