ORDER

This Criminal Original Petition has been filed to direct the 1st respondent Police to investigate and register FIR based on the petitioner's complaint dated 28.11.2020.

2. The learned Additional Public Prosecutor, Puducherry appearing on behalf of the 1st respondent Police submitted that the petitioner for the same relief had filed a Writ Petition in W.P.No.8000 of 2021, which is pending before this Court. The prayer therein is also to consider his representation dated 28.11.2020 and further, the respondent therein is also the 1st respondent herein. Hence, the petitioner is playing fraud on the Court by filing one petition or other on the similar prayer. https://hcservices.ecourts.gov.in/hcservices/

3. The learned counsel for the petitioner submitted that he is not aware about filing of Writ Petition and he was not instructed about any pendency of the Writ Petition by the petitioner. Hence, the learned counsel for the petitioner seeks permission of this Court to withdraw the Criminal Original Petition.

4. In view of the submission made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn.
