Respondent Prayer:- Petition has been filed under Section 24 of C.P.C., to withdraw and transfer HMOP No.38 of 2016 from the file of Subordinate Court at Tindivanam to the file of Principal Judge, Principal Family Court at Chennai.

O R D E R

This petition is filed to withdraw and transfer HMOP No.38 of 2016 from the file of Subordinate Court at Tindivanam to the file of Principal Judge, Principal Family Court at Chennai.

2. When the matter is taken up for hearing, the learned counsel for the respondent submitted that HMOP No.43 of 2017 filed by the petitioner is pending before III Additional Family Court, Chennai and hence the respondent has no objection in transferring the case in HMOP No.38 of 2016, pending on the file of Sub Court, Tindivanam to III Additional Family Court, Chennai to be tried alongwith HMOP No.43 of 2017 and made an endorsement to that effect.

3. Recording the submission and endorsement made by the learned counsel for the respondent, without deciding the issue on merits, the petition in H.M.O.P.No.38 of 2016 is ordered to be withdrawn from the file of Sub Court, Tindivanam and transferred to the file of III Additional Family Court, Chennai, to be tried alongwith HMOP No.43 of 2017 pending on its file. The Presiding Officer, Sub Court, Tindivanam is directed to transmit all the records pertaining to H.M.O.P.No.38 of 2016 https://hcservices.ecourts.gov.in/hcservices/

to the file of the IIII Additional Family Court, Chennai, within a period of two weeks from the date of receipt of a copy of this order.

4. Accordingly, this Transfer Civil Miscellaneous petition is ordered. No costs.
