First Information Report has been registered against this petitioner for the offence under Sections 354D IPC and Section 11(1) & 11(4) of POCSO Act, 2012.

The sum and substance of the complaint given by the mother of the minor child indicates that the petitioner was staring at the minor girl while she was attending typewriting class and had shown some obscene signals and the petitioner is stalking her. 3.

The learned counsel appearing for the petitioner submits that the petitioner is a life convict who came out on parole on the relevant point of time. He has been falsely implicated in this case. 4.

However, this Court finds that the complaint has been given by the mother, who is a professor in a college and there is prima facie material to suspect the content of the FIR. However, it is for the Investigating Officer to conduct the investigation and arrive at a conclusion based on the material facts collected during the course of the investigation. Therefore, this Criminal Original Petition to quash is dismissed. The respondent police is directed to complete the investigation within a period of three months from today. 05.06.2024 Index : Yes/No rpl 2/4
