PRAYER : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to set aside the returned docket order in Crl.M.P.S.R.No.1339 of 2022 dated 09.05.2022 on the file of Special Court for NDPS Act at Salem and grant bail to the petitioner in Crime No.38 of 2022 on the file of the first respondent.

O R D E R

This petition has been filed by the petitioner seeking to set aside the returned docket order in Crl.M.P.S.R.No.1339 of 2022 dated 09.05.2022 on the file of Special Court for NDPS Act at Salem and grant bail to the petitioner in Crime No.38 of 2022 on the file of the first respondent.

2. The said application was filed for bail and it had been returned with the endorsement that "As per the provision of NDPS Act A3 remanded on 12.02.2022 judicial custody in 86 days 90 days not reached hence returned". It is stated by the learned counsel for the petitioner that the charge sheet had been filed on 91st day. It is informed by the learned Government Advocate (crl.side) that the petitioner has been detained under Act 14 of 1982.

3. Since the petitioner is now detained under the Act 14 of 1982, no effective order can be passed granting relief to the petitioner.

4. Accordingly, this Criminal Original Petition stands disposed of.
