This writ petition is filed under Article 226 of the Constitution of India seeking writ of certiorarified mandamus calling for the records relating to impugned proceedings R.C.No 5028 / 2024 / A1 dated 16.04.2025 on the file of the 4th respondent and quash the same and consequently direct the respondents to sanction the gratuity with interest from 1998 onwards i.e., the date of retirement of petitioner's husband Mr.R. Gopal pension arrears from taken into consideration of his entire service form 1998 i.e. the date of retirement of petitioner husband Mr. R. Gopal family pension arrears form 1999 onwards form the date of death of petitioner husband Mr. R. Gopal till date, and family pension as per pay commission rules.

ORDER

This writ petition is filed for the following relief: "To call for the records relating to impugned proceedings R.C.No 5028 / 2024 / A1 dated 16.04.2025 on the file of the 4th respondent and quash the same and consequently direct the respondents to sanction the gratuity with interest from 1998 onwards i.e., the date of retirement of petitioner's husband Mr.R.

Gopal pension arrears from taken into consideration of his entire service form 1998 i.e. the date of retirement of petitioner husband Mr. R. Gopal family pension arrears form 1999 onwards form the date of death of petitioner husband Mr. R. Gopal till date, and family pension as per pay commission rules."

2. The petitioner's husband, Mr.R.Gopal was appointed as a Village Assistant on 01.07.1978, at Adhanur Komal Village, Alathampadi, Thiruthuraipoondi. The petitioner's husband served as Village Assistant for more than 20 years and retired from service in the year 1998. The petitioner's husband died on 18.01.1999, due to ill health.

3. The petitioner would submit that her husband was enrolled in the Tamil Nadu Government Employees' Special Provident Fund cum Gratuity Scheme. The case of the petitioner is that the gratuity amount has not been paid to the petitioner till date. Therefore, the petitioner made representation to respondents to grant family pension as well as the provident fund cum gratuity amount. In this regard, the 3rd respondent issued a memo to the 5th respondent to take immediate action.

4. The 5th respondent recommended to the 4th respondent vide letter dated nil.01.2023, that the petitioner is entitled to receive special provident fund cum

gratuity as well as family pension. Since there was no response the petitioner approached this Court in WP.No.22942 of 2024 and the same was disposed of directing the petitioner to make a fresh representation.

The petitioner made a fresh representation and thereafter, the 5th respondent sent a proposal to the 4th respondent to sanction family pension of Rs.250/- from 18.01.1999 and Rs.560/- from 07.04.2010 onwards. The petitioner's grievance is that subsequent hike in family pension was not mentioned in the proposal.

6. The petitioner would submit that the 5th respondent by proceeding dated 16.04.2025, sanctioned a sum of Rs.5483/- as gratuity, which is against the pension rules. Further, no interest was mentioned for the delayed payment of the gratuity amount. Therefore, the petitioner is before this Court.

7. Heard the learned counsel for both sides and perused the records.

8. The petitioner's husband retired from service in the year 1998. However, the amount has not been paid to the petitioner constraining her to approach this Court in WP.No.22942 of 2024. Thereafter, the 5th respondent sanctioned a sum of Rs.5483/- as gratuity, without interest. Therefore, the respondents are directed to settle the gratuity amount to the petitioner with

interest at the rate of 10% p.a.

9. As far as the family pension is concerned, it is brought to the notice of this Court that the issue is now pending before the Principal Accountant General, the 7th respondent. The 7th respondent shall consider and pass orders on the communication received by them.

10. Both the exercises shall be completed, within a period of 8 weeks from the date of receipt of a copy of this order.

11. With the above directions, this writ petition is disposed of. Consequently, the connected miscellaneous petition is closed. No costs. 01-06-2026 Index: Yes/No Speaking/Non-speaking order KAN
