ORDER

The petitioner seeks for registration of the sale deed presented by the petitioner, pending as TP/238487034/2025 dated 07.11.2025 and consequently, release the registered document to the petitioner within a time frame to be fixed by this Court.

2. Mr. P. Harish, learned Government Advocate accepts notice on behalf of the first respondent. On instructions, he would submit that a protest petition has been filed by a third party, objecting to the registration of any document pertaining to the property, which is the subject matter of the sale deed presented by the petitioner for registration.

3. As seen from the affidavit filed in support of this writ petition, the second respondent is also interfering with the peaceful possession and enjoyment of the property by the petitioner. Necessarily, both the parties viz., the second respondent as well as the third party, who has filed the protest petition will have to be heard by the first respondent before the first respondent takes a final decision as to whether the sale deed presented by the petitioner can be registered or not.

4. The learned Government Advocate appearing for the first respondent would also submit that within a time frame to be fixed by this Court, enquiry

will be conducted by the first respondent and a decision will be taken by the first respondent as to whether the sale deed presented by the petitioner can be registered or not.

5. This Court is not expressing any opinion on the merits of the respective contentions.

6. Since no adverse orders are passed against the second respondent, notice to the second respondent is dispensed with by this Court.

7. For the foregoing reasons, this writ petition is disposed of by directing the first respondent to conduct enquiry by hearing the contentions of the petitioner as well as the contentions raised by the second respondent as well as the third party, who has filed the protest petition and after giving due consideration to the supporting documents filed by all the parties, the first respondent shall take a final decision as to whether the sale deed can be registered or not within a period of three weeks from the date of receipt of a copy of this order.

8. In case, the first respondent decides to refuse registration of the sale deed presented by the petitioner, the first respondent shall pass a speaking order, after giving due consideration to the contentions of the petitioner as well as the
