Respondents PRAYER: This Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, forbearing 3rd respondent from interfering with the peaceful conduct of business in the name of Dazzle U SPA and Ayurvedic Massage at No.7/2 Chandra Complex, Thiruvallur Salai, Thiruvanmiyur, Chennai-41.

O R D E R

The relief sought for in the present writ petition is to forbear the 3rd respondent from interfering with the peaceful conduct of business in the name of Dazzle U SPA and Ayurvedic Massage at No.7/2 Chandra Complex, Thiruvallur Salai, Thiruvanmiyur, Chennai-41.

2. The police officials in the event of receiving any information regarding commission of offence or otherwise, empowered to conduct an inspection, in the manner known to law. The powers conferred under the statute cannot be taken away, by granting such an injunction, as such sought for in the present writ petition.

3. No doubt, the authorities are expected to conduct such inspection by following the procedures contemplated under the Code of Criminal Procedure. Therefore, the general relief, as such sought for by the writ petitioner cannot be granted. However, the police officials while conducting such inspections on receipt of any information, must follow the procedures as contemplated.

4. With these observations, the writ petition stands disposed of. No Costs. Consequently, the connected Writ Miscellaneous Petition is closed.
