Div) No.23 of 2021 N.ANAND VENKATESH, J ., Pursuant to earlier orders passed by this Court, the name of the defendant has been printed in the cause list. Even today, there is no representation for the defendant. This Court, by an order dated 21.12.2021 directed the defendant to furnish security. This order has not been complied with and the defendant has not entered appearance.

2. In view of the same, there shall be an order of attachment before judgment of the schedule mentioned property in the application.

3. The learned counsel for the applicant/plaintiff shall file necessary batta on or before 07.02.2022 and the attachment shall be effected.

4. Accordingly, this application is allowed.

5. Registry has put up a note to the effect that the suit summons sent to the defendant has been returned unserved. The learned counsel for the plaintiff is directed to take an application for substituted service on the defendant in the suit.

6. Post this case under the caption 'FOR PASSING FURTHER ORDERS' on 21.02.2022.

7. In the meantime, the application for substituted service shall be filed, numbered and brought up for hearing.
