O R D E R
This writ petition has been filed seeking issuance of Writ of Mandamus directing the respondent to provide electricity connection to the petitioner's residential house situated in 7/116G1, Saminathapuram, Kelkathavukarai, Karegoundenpalayam, Annur Taluk, Coimbatore District based on the application submitted by the petitioner dated 28.12.2024 vide Application No.2000312512241226 within a time frame.
2.The learned counsel appearing for the petitioner submitted that the petitioner made representation to the first respondent seeking three phase domestic residential electricity connection, however, there is no response.
3.The learned Standing Counsel appearing for the first respondent submitted that during the application made by the petitioner was cancelled on 24.01.2025.

4.The learned counsel appearing for the second respondent submitted that the petitioner encroached the property of the second respondent to an extent of 8 cents for which, a civil suit in O.S.No.836 of 2024 has been filed on the file of the learned Sub Judge, Coimbatore for delivery of possession of the encroached property and for consequential injunction in which interlocutary application was filed for appointment of Advocate Commissioner and the trial Court also appointed Advocate Commissioner in I.A.No.03 of 2024 and the Advocate Commissioner has also filed a report stating that the petitioner has encroached 8 cents of land. Hence, the Electricity Board have no power to grant electricity service connection. If at all the petitioner wants electricity service connection, the petitioner has to file interlocutory application before the trial Court. 5.Heard both sides and perused the materials available on record.
6.The petitioner made representation to the first respondent seeking three phase domestic residential electricity connection and the said application was cancelled on 24.01.2025. It appears that a civil suit in O.S.No.836 of 2024 has been filed on the file of the learned Sub 3/5
Judge, Coimbatore on the ground that the petitioner encroached the property of the second respondent to an extent of 8 cents, in which interlocutory application was filed for appointment of Advocate Commissioner and Advocate Commissioner was also appointed in I.A.No.03 of 2024 and the Advocate Commissioner has also filed a report stating that the petitioner has encroached 8 cents of land. 7.In view of the above, the Electricity Board have no power to grant electricity service connection. The writ petition is dismissed. Liberty is granted to the petitioner to make appropriate application before the civil Court where the civil suit is pending. No costs.
