Criminal Original Petition filed to direct the respondent to register the petitioner's complaint dated 17.03.2015 and to investigate the same.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for respondents.
3.The learned counsel appearing for the petitioner submitted that a copy of the complaint dated 17.03.2015 has already been sent to the first respondent along with the discharge summary and the same have been filed in the typed set of papers.
3.It is represented by the learned Additional Public prosecutor that the complaint dated 17.03.2015 has not been https://hcservices.ecourts.gov.in/hcservices/
received by the respondent police and the same has been sent by post by the petitioner.
4.In view of the submission of the learned Additional Public Prosecutor, the petitioner is directed to send a fresh complaint along with the earlier complaint dated 17.03.2015 to the police, within a period of fifteen days from the date of receipt of a copy of this order. On receipt of the complaint, the respondent police is directed to conduct enquiry and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, as per the dictum laid by the Hon'ble Supreme Court in Lalita Kumari vs. Government of Uttarpradesh and others reported in (2014) 2 SCC 1. The said investigation shall be completed, within a period of one month from the date of receipt of a complaint. In case the complaint is closed, the respondent police is directed to send the Closure Report to the petitioner, within a period of one week from the date of closing the report. Accordingly, this petition is closed.
