PRAYER in CMP.No.25603 of 2023: The Civil miscellaneous petition filed under Section 151 of CPC to grant an order of interim injunction restraining the respondents from proceeding further pursuant to the gazette notification published under Section 15(1) of the Tamil Nadu Highways Act 2001 vide Tamil Nadu Government Gazette Notification No.530/2020 Part VI, Section -1 dated 17.12.2020 in No.VI(1)/510(d-3) 2020 by the 2nd respondent and proceeding dated 19.02.2021 issued by the 4th respondent under Section 19(3) of the Tamil Nadu Highways Act 2001 in so far as the petitioner's land is concerned pending disposal of the above said writ petition.

ORDER
(The order of this Court was made by S.M.Subramaniam,J.,) The learned Additional Advocate General appearing for the respondents, relying on the present position of the Road widening projects, would contend that the portion of the land acquired from the appellant alone is left out and remaining portion of the projects in all respects completed. This Court has seen the photographs produced by the State, which would indicate that the present position is posing a danger to the road users. Therefore, completion of the road projects would be of paramount importance in the interest of public and for free flow of traffic on the highways.

2.Under these circumstances, completion of the projects in all respects is just and necessary for the benefit of the public at large and to avoid any untoward incidents/accidents. That apart, no prejudice would be caused to the appellant at this point of time since the land acquisition proceedings in all respects completed, the award passed, compensation amount deposited and possession taken and the projects implemented in respect of all other adjacent lands acquired for road widening project. 3.That being the factum, the Interim order granted in CMP.No.9610 of 2025 in W.A.No.3084 of 2023 stands vacated. The respondents authorities shall complete the projects in all respects for the benefit of the public at all road users.
4.The learned Additional Advocate General, on instructions, would submit that the projects will be continued and will be completed on or before 31.12.2025.

5.In view of the above, the CMP.Nos.9610 of 2025 and 25603 of 2023 are closed.
