Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent particularly 3rd respondent to consider the petitioners representation dated 20.02.2021 and issue a patta in respect of S.F.No.981, Irumporai Village, Karamadai Panchayat Union, Mettupalayam, Coimbatore District to an extent of 1.47 acres.

O R D E R

The prayer sought for herein is for a Writ of Mandamus directing the respondent particularly 3rd respondent to consider the petitioners representation dated 20.02.2021 and issue a patta in respect of S.F.No.981, Irumporai Village, Karamadai Panchayat Union, Mettupalayam, Coimbatore District to an extent of 1.47 acres.

2. The property in Survey No.981, Irumporai Village, Karamadai Panchayat Union, Mettupalayam, Coimbatore District to an extent of 1.47 Acres, according to the petitioner,

originally belonged to one Arumugam @ Owan, who said to have purchased the property in 1958 by a registered sale deed. The said Arumugam bequeathed a will in favour of one Palanisamy who executed a registered settlement deed in favour of one Senthurpandian, from whom the petitioner has purchased the property by way of a registered sale deed dated 29.03.2016. Since then, the petitioner claimed that he is in possession and enjoyment of the property concerned. Therefore, in order get patta for the said property, the petitioner has given a representation to the respondents especially the third respondent Tahsildar, who is the competent authority to issue patta on 20.02.2021 and since the same has not been considered, the petitioner has filed the present writ petition with the aforesaid prayer.

3. Mr.T.Arul, learned counsel for the petitioner, by reiterating the aforesaid facts, seeks the indulgence of this Court to give suitable direction to the respondents to consider the representation of the petitioner.

Mr.K.M.D.Muhilan, learned Government Advocate appearing on behalf of the respondents would submit that, if at all any such representation has been submitted by the petitioner on 20.02.2021 seeking patta for the land in question, the same would be considered on merits and orders would be passed thereon within a time frame that may be stipulated by this Court.

5. I have considered the submissions made by the learned counsel appearing for both sides and have considered the materials placed on record.

6. Considering the innocuous nature of the prayer sought for in the writ petition, this writ petition is disposed of with the following order.

That there shall be direction to the third respondent to consider the representation of the petitioner dated 20.02.2021 and pass orders thereon on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

7. With the above directions, this writ petition is disposed of. No costs.
