PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to transfer the investigation in Crime No.128 of 2018 on the file of the 2nd respondent to any other appropriate investigation officer or agency to conduct fair and free investigation and file a final report before the Jurisdictional Magistrate.

O R D E R

The Criminal Original Petition has been filed to transfer the investigation in Crime No.128 of 2018 on the file of the 2nd respondent to any other appropriate investigation officer or agency to conduct fair and free investigation and file a final report before the Jurisdictional Magistrate.

2.The learned Additional Public Prosecutor would submit that after registering the FIR in Crime No.128 of 2018, as against the accused persons, investigation has been completed and also https://hcservices.ecourts.gov.in/hcservices/

filed final report on 19.01.2020, before the Judicial Magistrate, Neyveli and it is pending for taking cognizance. Therefore, transfer of investigation from the file of the 2nd respondent would not arise, since the respondent police filed final report.

3.Considering the above submission, the transfer of investigation is not at all supportive for this case, since the 2nd respondent filed the final report before the Judicial Magistrate, Neyveli, in Crime No.128 of 2018. Therefore the Criminal Original Petition is disposed of.
