Respondents Writ Petition under Article 226 of the Constitution of India praying for a writ of mandamus directing the respondents to consider the petitioner representation dated 22.12.2014 in so far as in the said representation the petitioner had sought for to continue to issue the old age pension which was granted to the petitioner under the Revenue Department Social Security Scheme by the Tahsildar vide No.TRT/DWP/G/2976/2009 as the petitioner have not received the said widow and old age pension from October 2014 without any reason whatsoever by the respondents requiring the judicious consideration of this Honourable Court.

ORDER

By consent, the main writ petition is taken up for final hearing. The petitioner would state that she belongs to Scheduled Caste Community and out of wedlock she begot two male children and that her husband also died in the year 2006. It is further stated by the petitioner that the children had also deserted her and she is earning her livelihood from doing maid works. It is further stated by the learned counsel for the petitioner that the village members taking into consideration of her plight allowed her to put up a hut at Kalambakkam Village, Thiruvallur District and she made a request for payment of old age and widow pension and she was granted the same vide proceedings No.TRT/DWP/G/2976/2009.

The petitioner would state that though she was regularly receiving the old age pension through the Department of 3-Posts, MO (Payment) and all of a sudden she was not paid from October 2014 onwards. The petitioner in this regard has submitted a representation dated 22-12-2014 to the respondent. Though it was received by the third respondent, she has not been favoured with any response and hence has come forward to file this writ petition.

Mr.R.A.S.Senthilvel, learned Additional Government Pleader accepts notice on behalf of the respondents.

This Court taking into consideration the limited scope of the prayer and without going into the merits of the same, directs the third respondent to consider and dispose of the representation, dated 22-12-2014 on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner.
