ORDER

This Criminal Original Petition has been preferred seeking to direct the respondents to comply with the order dated 08.06.2017 passed by this Court in Crl.O.P. No.8443 of 2017 and consequently, direct the respondents to conduct the investigation in a reasonable time.

Today, Ms. Chitra, Inspector of Police, E.O.W. (Headquarters), who is the Investigating Officer for the case at hand, is present before this Court. She has filed a status report dated 04.06.2018 detailing the steps that have been taken to secure Amardeep Singh Saran (A2) and other accused involved in E.O.W. II Chennai Cr. No.3 of 2016.

On instructions, the learned Government Advocate (Crl. Side) submitted that the petitioner will also be taken as a witness in E.O.W. II Chennai Cr. No.3 of 2016. At this juncture, it is worth pointing out that while holding sitting at the Madurai Bench, I had an occasion to deal with the issue at hand in Crl.O.P. (MD) Nos. 18312 to 18314 of 2016, wherein, on 21.02.2018, a detailed order was passed. It would suffice to extract paragraph no.4 of the said order as under:

4. On a perusal of the Criminal Original Petitions and connected records, it is seen that Ammandeep Singh Sran is still in the Central Prison, Raipur, as could be seen from the vakalat that has been executed by him before the Superintendent of Prison, Central Prison, Raipur. In such view of the matter, this Court is of the view that it may be necessary to issue the following direction to the Superintendent of Prison, Central Prison, Raipur, Chhattisgarh State:

"The Superintendent of Prison, Central Prison, Raipur shall not release Ammandeep Singh Sran, S/o.Harmander Singh Sran from custody even if he has been granted bail by the Courts in other States and in execution of the Prisoner Transit warrant issued by the Special Court for TNPID Act Cases, Madurai, produce him before the Special Court for TNPID Act Cases, Madurai. On such production, it is open to the Tamil Nadu State police to intervene and take further proceedings in the three

pending cases against him."

In view of the above, the respondent police is directed to take all steps for attaching the properties of the financial establishment under the TNPID Act and expeditiously complete the investigation. Liberty is given to the petitioner to provide all information about the accused company to the E.O.W.II, Chennai, for their investigation.

With the above directions, this Criminal Original Petition is disposed of. Connected Crl.M.P. is closed.
