PRAYER: Civil Revision Petition is filed under Section 115 C.P.C., to set aside the Fair and Decreetal Order dated 27.02.2024 passed in IA No.9 of 2023 in OS No.3962 of 2019 pending on the file of Learned XVIII Additional Judge, City Civil court, Chennai.

ORDER

This Court, by order dated 27.06.2025, directed the trial Court to dispose of the suit in O.S.No.3962 of 2019 within a period of four months from the date of receipt of a copy of the order.

2. The learned XVIII Additional Judge, City Civil Court, Chennai, by communication in Dis.No.631/2025 dated 25.11.2025, has expressed certain difficulties in complying with the directions issued by this Court and has sought reasonable time. It is seen that the witness DW.1 did not appear due to unavoidable pre-commitments and thereafter, the matter was posted to 11.12.2025, on which date the trial could not be completed. It is also seen that the suit is now at the stage of cross examination of DW.1 and that I.A.No.07 of 2023 is also pending. In view of the above, I am inclined to grant time to the trial Court to dispose of the suit in O.S.No.3962 of 2019 by end of February 2026.
